Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the WarriorPerformanceLab.com website (the "Service") operated by Ayda Page, Pono Software Inc. ("Warrior Performance Lab", "us", "we", or "our"). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
Purchases
If you wish to purchase any product or service made available through the Service ("Purchase"), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information. You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete. By submitting such information, you grant us the right to provide the information to third parties for purposes of facilitating the completion of Purchases. We reserve the right to refuse or cancel your order at any time for certain reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons. We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.
Prices shown may exclude applicable taxes, duties, levies, or VAT/GST unless stated otherwise. Where required by law, such amounts will be added at checkout based on your billing details and jurisdiction.
Due to the nature of intellectual property and e-commerce law, there are no refunds for programming purchases. All sales of digital products — including but not limited to training plans, nutrition plans, and downloadable or online programming — are final and non-refundable. By purchasing, you acknowledge that you receive immediate access to digital content and therefore waive any rights to cancellation or refund to the fullest extent permitted by law. If you purchase via the Apple App Store or Google Play, the transaction is with that platform and any refunds are governed by the platform’s terms and processes. We are not able to issue refunds for App Store or Play Store purchases.
For customers located in the European Union: under EU consumer protection law, you may have a statutory right to withdraw from certain purchases within 14 days. However, by purchasing digital content from Warrior Performance Lab that is made available for immediate download or access (including training plans, nutrition plans, and other online programming), you expressly consent to the immediate performance of the contract and acknowledge that you thereby lose your right of withdrawal. This exception is provided under Directive 2011/83/EU on Consumer Rights and its national implementations.
We may offer the option to schedule one or more payments to be automatically deducted from your checking, savings, or credit account ("Subscription billing"). When you make a purchase with subscription billing, your payment authorization will remain in effect until the programming agreement is paid in full, and you agree to notify Warrior Performance Lab in writing of any changes in your account information or termination of this authorization at least 15 days prior to the next billing date. If the above noted periodic payment dates fall on a weekend or holiday, the payment may be executed on the next business day. In the case of an ACH/EFT Transaction being rejected for Non Sufficient Funds (NSF), Warrior Performance Lab may at its discretion attempt to process the charge again within 30 days, and an additional service charge for each attempted and returned NSF will be initiated as a separate transaction from the authorized recurring payment. The origination of ACH/EFT transactions to your account must comply with the provisions of U.S. law. You agree not to dispute this recurring billing with your bank so long as the transactions correspond to the terms indicated here. You may prepay any portion of the total purchase amount without penalty. Failure to continue ACH/EFT transactions to fulfill your purchase results in the remainder of the program cost to come due immediately.
You may cancel your subscription at any time by contacting us in writing through warriorperformancelab.com/contact. Your subscription will remain active until the end of the current billing cycle, and no further payments will be charged after cancellation is confirmed. If you purchased a subscription through the Apple App Store or Google Play, you must cancel through your App Store account settings; we cannot cancel App Store or Play Store subscriptions on your behalf. For web purchases made directly with us, cancellations must be submitted through warriorperformancelab.com/contact or via the account portal. Subscriptions renew automatically until canceled. Access remains available through the end of the current billing period and no partial refunds are provided for unused time.
After successful payment, digital content is delivered immediately via in-app access and/or download link in your account.
Unauthorized Payment Disputes (Chargebacks): If you initiate a chargeback or payment dispute for a valid charge, we may suspend or terminate access to the associated digital content or services and pursue the outstanding balance, including any third-party processing fees incurred as a result of the dispute.
Availability, errors and inaccuracies
We are constantly updating our offerings of products and services on the Service. The products or services available on our Service may be mispriced, described inaccurately, or unavailable, and we may experience delays in updating information on the Service and in our advertising on other web sites. We cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.
Contests, Sweepstakes and Promotions
Any contests, sweepstakes or other promotions (collectively, "Promotions") made available through the Service may be governed by rules that are separate from these Terms. If you participate in any Promotions, please review the applicable rules as well as our Privacy Policy. If the rules for a Promotion conflict with these Terms, the Promotion rules will apply.
Accounts
When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trade mark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene.
Age Requirement
You must be at least the age of digital consent in your jurisdiction to use the Service (13 in the United States; 16 in many EU member states). If you are under the age of majority in your jurisdiction, you may use the Service only with the consent and supervision of a parent or legal guardian, who agrees to be bound by these Terms.
Intellectual Property
The Service and its original content, features and functionality are and will remain the exclusive property of Warrior Performance Lab and its licensors. The Service is protected by copyright, trademark, and other laws of the United States, Canada and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Warrior Performance Lab.
All training programs provided by Warrior Performance Lab, including all content, exercises, plans, and materials, are protected under copyright law. They are intended solely for the use of the individual who has purchased or received them directly from Warrior Performance Lab. You may not copy, distribute, modify, or share the Warrior Performance Lab training programs with others without explicit written permission from the program creator. Unauthorized use, reproduction, or distribution is strictly prohibited and may result in legal action.
Links To Other Web Sites
Our Service may contain links to third-party web sites or services that are not owned or controlled by Warrior Performance Lab. Warrior Performance Lab has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Warrior Performance Lab shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services. We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.
Termination
We may terminate or suspend access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnities, and limitations of liability.
Indemnification
You agree to defend, indemnify and hold harmless Warrior Performance Lab and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password, or b) a breach of these Terms.
AI-Assisted Features and Generated Content
Some parts of our coaching services and the Service may include AI-assisted features (for example, summarizing check-ins, generating drafts of training or nutrition plans, generating suggested content, automations, and other outputs). These features may be provided through our coaching software platform and may use third-party AI services.
AI-generated output is generated automatically and may be inaccurate, incomplete, outdated, misleading, or inappropriate. You agree that you will not rely on AI-generated output as a substitute for professional judgment or medical advice, and you will use appropriate caution and common sense when following any plan, recommendation, or content.
AI-assisted output (and any training or nutrition content we provide) is for informational purposes only and is not medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider before starting or changing a fitness or nutrition program. You acknowledge that any training or nutrition plan—whether created by a coach, generated by AI, or both—must be used with care and at your own risk.
We may store AI inputs and outputs in logs within our coaching platform to support your account, provide our services, maintain records, and for security purposes. If you would like us not to use AI-assisted features in connection with your personal information, please contact us.
Privacy and data collection
Your use of our Service is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal data. Exclusions
Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you.
Governing Law
These Terms shall be governed and construed in accordance with the laws of British Columbia, Canada, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
Certain mandatory consumer protection laws in your jurisdiction may apply in addition to these Terms.
Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
